These Terms incorporate Apple's Standard End User License Agreement (EULA), available at:

In the event of any conflict between these Terms and Apple's EULA, Apple's EULA shall govern with respect to terms specific to Apple's platform.
Marmot-Apps grants you a limited, non-exclusive, non-transferable, revocable license to use MarmotHome on Apple-branded devices that you own or control, subject to these Terms and the App Store Terms of Service.

MarmotHome offers optional auto-renewable subscriptions ("MarmotHome Pro") to unlock premium features including advanced AI design suggestions and unlimited scan storage.
You agree to use MarmotHome only for lawful purposes. You must not:
AI-powered features (design suggestions, room analysis, furniture recommendations, etc.) are provided "as-is" and may not always be accurate or complete. AI outputs should not be used as a substitute for professional architectural, engineering, interior design, or other expert advice. You are responsible for verifying the accuracy of AI-generated content before relying on it.
By using AI features, you acknowledge that room measurement and layout data is transmitted to third-party AI providers as described in our Privacy Policy.
MarmotHome uses LiDAR and camera data to generate room measurements, 3D models, and floor plans. While we strive for accuracy, these measurements are estimates and may vary depending on device capabilities, environmental conditions, and scanning technique.
MarmotHome, the MarmotHome name, the marmot character, logo, and all app content are the intellectual property of Marmot-Apps and are protected by copyright, trademark, and other applicable laws.
You retain full ownership of all room scans, 3D models, measurements, floor plans, and content you create using the App. By using AI features, you grant us a temporary, limited license to transmit your room data to third-party AI providers solely for the purpose of generating your requested output.
THE APP IS PROVIDED "AS IS" AND "AS AVAILABLE" WITHOUT WARRANTIES OF ANY KIND, EITHER EXPRESS OR IMPLIED, INCLUDING BUT NOT LIMITED TO IMPLIED WARRANTIES OF MERCHANTABILITY, FITNESS FOR A PARTICULAR PURPOSE, AND NON-INFRINGEMENT. MARMOT-APPS DOES NOT WARRANT THAT THE APP WILL BE UNINTERRUPTED, ERROR-FREE, VIRUS-FREE, OR THAT ANY DEFECTS WILL BE CORRECTED. MARMOT-APPS DOES NOT WARRANT THE ACCURACY OF ANY MEASUREMENTS, 3D MODELS, OR FLOOR PLANS GENERATED BY THE APP.
TO THE MAXIMUM EXTENT PERMITTED BY APPLICABLE LAW, MARMOT-APPS AND ITS AFFILIATES SHALL NOT BE LIABLE FOR ANY INDIRECT, INCIDENTAL, SPECIAL, CONSEQUENTIAL, OR PUNITIVE DAMAGES, INCLUDING BUT NOT LIMITED TO LOSS OF DATA, LOSS OF SCAN DATA, LOSS OF REVENUE, OR LOSS OF PROFITS, ARISING OUT OF OR RELATED TO YOUR USE OR INABILITY TO USE THE APP, EVEN IF ADVISED OF THE POSSIBILITY OF SUCH DAMAGES.
OUR TOTAL LIABILITY TO YOU FOR ANY CLAIMS ARISING FROM THESE TERMS SHALL NOT EXCEED THE AMOUNT YOU PAID US IN THE TWELVE (12) MONTHS PRECEDING THE CLAIM.
These Terms shall be governed by and construed in accordance with applicable law. Any disputes arising under these Terms shall be subject to the exclusive jurisdiction of competent courts. Nothing in this section limits your rights as a consumer under applicable mandatory local law.
We reserve the right to modify these Terms at any time. We will notify users of material changes via the App or this website and update the "Last updated" date above. Continued use of the App after changes constitutes acceptance of the revised Terms.
